STORE POLICY

​

  The Regulations define the rules for using the Ride and Get Lost Online Store for placing orders for products available in the Online Store and for individual orders, delivering the ordered products to the Customer, paying the Customer, the Customer's right to cancel the order and withdraw from the Agreement, rules for submitting and considering complaints . Before you make a purchase in our Online Store, read the Regulations.

 

§ 1 GENERAL PROVISIONS

 

Ride and get lost Online Store  operating at the address ————— is run by Ride and Get Lost PaweÅ‚ Ozimkiewicz with its registered office at: ul. Zachodnia 39/4 22-100 CheÅ‚m, entered into the register of entrepreneurs under the REGON number: 520460621, with NIP: 5632446922, hereinafter referred to as Ride and get lost  Contact details: e-mail:  rideandgetlost@gmail.com

  1. The products offered by the Ride and get lost Online Store may be made of dyed materials, which means that the colors of the products may actually differ slightly from the ones shown in the photos showing the prototype. At the same time, all products are described in detail in terms of their characteristics, materials used and properties. Please note that differences in colors between the goods received and the photos presented in the Store may result from the parameters of the monitor settings.

  2. Information about products in the Ride and get lost store  incl. descriptions, prices constitute an invitation to submit an offer to conclude a sales contract within the meaning of art. 71 of the Civil Code and the Regulations.

  3. All photos on our website are our authorship and are protected in accordance with the provisions of the Act of February 4, 1994 on copyright and related rights (Journal of Laws of 2006, No. 90, item 631, as amended)

 

§ 2 DEFINITIONS:

  1. ONLINE STORE - a store that offers sale of products via the Internet.

  2. CUSTOMER - a natural person, legal person or organizational unit without legal personality but having legal capacity, which, on the terms set out in these Regulations, made a purchase in the Online Store;

  3. CONSUMER - a customer who is a natural person who makes a purchase in the Online Store on the terms set out in these Regulations for a purpose not directly related to his business or professional activity;

  4. WORKING DAYS - days of the week from Monday to Friday, excluding public holidays in the territory of the Republic of Poland;

  5. PURCHASE OFFER - an offer to conclude a Sales Agreement sent by the Customer at the time of finalizing the purchasing process in the Online Store;

  6. ORDER - all products indicated by the Customer in the Purchase Offer and accepted by Tartaruga for execution;

  7. ORDER FULFILLMENT TIME - the time it takes for Ride and get lost to complete the Order and send the shipment to the Customer;

  8. DELIVERY TIME - the time it takes for the Courier Company to deliver the Order to the address provided by the Customer from the moment the parcel is correctly shipped by Ride and get lost;

  9. PRODUCT PRICE - gross price (including VAT) of a single item of the product set by Ride and get lost  and indicated on the product page;

  10. FINAL PRICE - the gross price of a single item of the product reduced by the price discounts applicable at a given time or for a given Customer, determined by Ride and get lost, presented in the "basket" section in the summary of the shopping process. The Final Product Price may not be higher than the Product Price specified on the product page;

  11. TOTAL PRICE - the sum of the Final Prices for all products included in the Purchase Offer or the Order;

  12. SHIPPING COSTS - fixed by Ride and get lost  costs of sending the order to the Customer in accordance with the selected delivery method to the indicated address.

  13. PURCHASE OFFER VALUE - the sum of the Total Price and Shipping Costs for a particular Purchase Offer;

  14. ORDER VALUE - the sum of the Total Price and Shipping Costs of products included in a specific Order accepted for execution;

  15. COURIER COMPANY - an entity providing transport services appointed by Ride and get lost to perform its obligations related to the delivery of the order to the Customer;

  16. PROOF OF PURCHASE - any document confirming the purchase of a given product in the Ride and get lost store. In particular, these are documents such as a fiscal receipt, invoice, bill,  confirmation of the transfer, confirmation of the order or confirmation of sending the shipment to the customer.

 

§ 3 REGISTRATION and SUBMISSION OF ORDERS  

​

  1. Purchases can be made 24 hours a day, 7 days a week via the Internet, on the website of the Online Store.

  2. Client submits Ride and get lost  an offer to conclude a Sales Agreement by clicking the "place an order" button in the "basket" section.

  3. By placing an order, the Customer declares that he has read these Regulations, and ignorance of the Regulations does not release the Customer from the obligation to comply with them.

  4. You can register on the Store's website. Registration is one-time. With each subsequent purchase, the Customer uses the login and password previously set on the Online Store website.

  5. Login and password are confidential. Liability for damages caused by the disclosure of them by the customer to third parties is borne only by the customer.

  6. The products indicated in the Purchase Offer are not subject to reservation and may be purchased by other Customers.
    In the Purchase Offer, the Customer indicates:
    a.) the product or products to be covered by the Sales Agreement,
      their features and number;
    b.) correct shipping details including: Customer's name and surname, company name (optional), exact address (company headquarters and / or place of delivery) including street name, house and apartment number, zip code, city name and country;
    c.) active e-mail address of the Customer;
    d.) Customer's active telephone number;
    e.) method of payment.

  7. The customer is solely responsible for the correctness of the indicated data and bears all financial costs related to address errors (in particular, the cost of sending the package to the wrong address and the cost of returning the package to the sender).

  8. To the e-mail address provided in the Ride and get lost Purchase Offer  sends an automatic confirmation of receipt of the offer. It is not a confirmation of the order being accepted for execution or the conclusion of a Sales Agreement.

  9. Ride and get lost may not accept a Purchase Offer without giving any reason in its sole discretion. The reason for not accepting the Purchase Offer may be, among others, the unavailability of a given product, restrictions related to its shipment, the inability to send the payment by the Customer, failure by the Customer to meet the criteria set out in the Regulations.

  10. Ride and get lost  shall not be liable to the Customer or third parties for not accepting the Purchase Offer.

 

§ 4 CANCELLATION OF THE ORDER BY THE CUSTOMER

The Customer may, after submitting a Purchase Offer, cancel it by sending an appropriate notification to Ride and get lost to the address  rideandgetlost@gmail.com  provided that the notice of resignation is sent prior to receipt of the confirmation of acceptance of the Order for execution.

 

§ 5 SALES AGREEMENT

​

  1. The Sales Agreement is concluded when it is sent to the Customer by Ride and get lost  confirmation of the acceptance of the Order for execution to the Customer's e-mail address.

  2. Failure to confirm the acceptance of the order for execution within two Business Days of sending the Purchase Offer shall mean that the Purchase Offer has not been accepted.

  3. Ride and get lost  may accept for execution only part of the products indicated in the Purchase Offer. In such a situation, the Customer will receive a confirmation of accepting part of the Order for execution.

  4. Under the Ride and Get Lost Sales Agreement, it undertakes to transfer the ownership of the products to the Customer and deliver them to the Customer in accordance with the provisions of these Regulations,  and the Customer undertakes to pay the Ride and get lost Order Value and to collect the Order.

condition precedent

  1. The Sales Agreement is concluded on the condition precedent that the Customer pays the Ride and get lost Value of the Purchase Offer or the Value of the Order within 3 days from the date of the Sale Agreement. The moment of payment is the date of confirmation of the payment order with the payment operator or posting the funds on the Ride and get lost bank account  in the case of direct payments.

  2. The legal effects resulting from the conclusion of the Sales Agreement arise at the moment when the condition precedent in question is met. Failure to meet this condition (failure to pay the Order Value) results in the termination of the Sales Agreement.

  3. The parties may, by individual, written (e-mail) arrangements, specify a different method of payment for the ordered products. In such a case, the condition in question is considered non-proprietary.

 

 

§ 6 PRODUCT PRICES

​

  1. The binding price of the product is the Final Price given in the order summary in the "Cart" section.

  2. All prices on the Ride and get lost website  are given in Polish zlotys or in euro.

  3. The value of the Purchase Offer is given in "your purchases" in the "basket" section after indicating the place of delivery of the Order and the form of payment.

  4. Ride and get lost  may change Product Prices on an ongoing basis and carry out various types of promotional campaigns and sales. Purchase Offers submitted prior to the publication of such changes will be implemented on the same terms.

 

§ 7 FORMS OF PAYMENT  

​

  1. Payment can be made:

  1. PAYPAL electronic payment system (also supports foreign transfers, credit cards),

  3.   2.   The payment for the Order shall be made by the Customer in advance, no later than within 3 Business Days from the date of receipt of the confirmation of the Order for execution from the Ride and get lost. This confirmation contains all the data necessary to make the payment, including the Value of the Order.

  1. Payment of the Value of the Purchase Offer may be made prior to Ride's acceptance of the Purchase Offer and get lost for execution. In such a case, it will be treated as an advance payment to which the provisions of the advance payment law do not apply. If the Purchase Offer is not accepted by Ride and get lost  or accepting only part of the Purchase Offer for execution, the advance payment will be refunded to the Customer in full  or the difference between the payment made and the Value of the Order accepted for execution will be refunded.

 

§ 8 DELIVERY OF THE ORDER

  1. Ride and get lost  carries out deliveries of ordered products:

  1. in the Republic of Poland via InPost on the terms and in accordance with the supplier's regulations 

  2. abroad via Poczta Polska and DPD on the terms and in accordance with the supplier's regulations  

 

  1. The delivery of the shipment to the customer is borne by the customer. The current delivery price list can be found on the Ride and get lost page under the shipping tab.

  2. By accepting the parcel from  supplier, check the packaging and its contents carefully. In case of damage, customer should contact Ride and get lost by  e-mail:  Rideandgetlost@gmail.com  or directly with the supplier.

 

 

 

§ 9 ORDER COMPLETION

​

  1. The execution of the Order should be understood as the completion and correct sending to the Customer of the shipment containing the products accepted for implementation in the confirmation of the Order.

  2. Orders accepted for execution will be processed immediately after receiving the confirmation of payment to the Ride and get lost account, but not later than within 10 (ten) Business Days.

  3. Products unavailable at the time the Customer submits a Purchase Offer or products personalized to the Customer's order are sent to the Customer at a time individually specified in the form of e-mail arrangements.

  4. Client will receive from Ride and get lost  information to the e-mail address with confirmation of shipment and the number of the consignment note.

 

§ 10 EXCHANGE OF GOODS

​

  1. Due to the individual nature of some of the items offered in Ride and get lost, not everyone can be exchanged. This restriction applies in particular to items made to individual customer orders. Therefore, in case of uncertainty, please check with the employees of the Online Store whether a possible replacement will be possible.

  2. Each case of replacing the product with another item is treated individually and, in principle, such an exchange is possible, subject to point. 1.

  3. The desire to replace the purchased item should be reported by e-mail to Ride and get lost no later than ten days after receiving the parcel, indicating in the e-mail which item is to be replaced and showing the proof of purchase.

  4. In case of receipt from Ride and get lost  confirmation that the exchange is possible, the Customer bears the cost of shipments of the replaced items to and from the Online Store.

  5. The exchange agreed with the Online Store is possible only if the returned goods do not bear any traces of use, are provided with original tags and are returned with a proof of purchase.

 

§ 11 COMPLAINTS  

​

  1. Complaints must be submitted in writing to the Ride and get lost e-mail or postal address  indicated in point 1 of the Regulations, no later than two months from the detection of a defect in the product, within 2 years from the release of the product to the Customer.

  2. Complaints procedure:

  1. Please take photos of the product (in particular the defect) and along with a description of the complaint form.

  2. Ride and get lost will make a decision on whether the complaint is justified or unfounded within 30 days from the date of receipt of the notification;

  3. If the complaint is accepted, the defective product must be delivered at the expense of Ride and Get Lost to the address indicated in point. 1 of the Regulations in the manner indicated in the e-mail information regarding the complaint.

  4. Ride and get lost  at its own expense, it will send the customer a repaired product, a new copy or return the money - depending on the customer's request - immediately, but not later than within 30 days of receiving the defective product.

§ 12 RIGHT TO WITHDRAW FROM THE CONTRACT

 

  • In accordance with the Act of May 30, 2014 "On consumer rights" (Journal of Laws No. 683 of 2017), the CONSUMER, within 14 days from the date of receipt of the shipment, may resign from the purchase (withdraw from the purchase contract without giving any reason) of the purchased goods in the Ride and get lost Online Store.

  • In order to exercise the right referred to in point 1, the Consumer is obliged to provide Ride and Get Lost with a written declaration of withdrawal from the concluded Sales Agreement.

  • To meet the 14-day deadline specified in the Act, it is enough to send a declaration within 14 days from the date of delivery to the Consumer, also by e-mail.

  • In the event of withdrawal from the contract by the Consumer in the above-described manner, he is obliged to return the purchased product at his own expense in a non-deteriorated condition allowing it to clearly state that the product has not been used, in its original packaging, within 14 (fourteen) days from the date of withdrawal from the contract. to the Ride and get lost address indicated in point 1 of the Regulations. The Ride and get lost store does not accept COD shipments.

  • In the event that the withdrawal from the contract is effective, Ride and Get Lost returns the CONSUMER the price for the product (including the cost of shipping to the Consumer).

 

 

 

 

§ 13 PROCESSING OF PERSONAL DATA  

​

  1. By making a purchase in the Ride and get lost Online Store, the Customer agrees to the processing of personal data for the purpose of completing the order.

  2. Personal data is protected in accordance with the Act of August 29, 1997 on the Protection of Personal Data (consolidated text, Journal of Laws of 2002, No. 101, item 926, as amended) in a way that prevents access  to them by third parties).

  3. Compliant with the above-mentioned Act, Customers have the right to access their personal data, correct them and request removal.

 

§ 14 FINAL PROVISIONS  

​

  1. Ride and get lost may at any time cease providing services, change the offer or withdraw the offered products without giving any reason.  These changes do not affect the performance of Sales Agreements concluded prior to the introduction of these changes.

  2. In matters not covered by these Regulations, the provisions of the law in force in the territory of the Republic of Poland shall apply, in particular the Civil Code and the Act on consumer rights.

  3. All names and designs of products offered by Ride and get lost in the Online Store are the property of Ride and get lost and may be protected and reserved under the provisions of the Industrial Property Law Act or other regulations.

  4. In the event of a change in the Regulations, the Sales Agreements concluded before the changes are introduced are implemented in accordance with the rules in force at the time of concluding the Sales Agreement.

  5. These Regulations are valid from 01/10/2017.
